GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale govern all relations between the company SAUMO (hereinafter referred to as "Saumo" or "the Seller") and any natural or legal person (hereinafter referred to as "the Customer") wishing to make a purchase on the www.saumoswimwear.com website (hereinafter referred to as "the Site").

2. Purpose of the T&Cs
The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of the parties in connection with the online sale of products offered by Saumo to the Customer, from the placing of an order to after-sales services, including payment and delivery.
3. Products
The products offered for sale are those described on the Site. These include swimwear and beach accessories. Each product sheet contains a detailed description (size, cut, composition, color, care, etc.).
Although photographs are taken with care, they may differ slightly from reality depending on screen display settings. Such variations cannot engage Saumo's liability.
All products are offered within the limits of available stock. In case of unavailability after an order is placed, Saumo will inform the Customer as soon as possible and offer an exchange or a refund.
4. Price
Prices are indicated in euros (€), all taxes included (TTC), excluding delivery costs.

For deliveries within the European Union, the applicable VAT is that in force in France.

For deliveries outside the EU, local taxes or customs duties may apply. These costs are the sole responsibility of the Customer and are neither prepaid nor reimbursed by Saumo.
Saumo reserves the right to modify its prices at any time, but products are invoiced at the rate in force at the time the order is validated.
5. Order
The Customer selects the products they wish to purchase, adds them to their cart, then validates their order after filling in their delivery details and accepting the T&Cs.
The order is considered final once payment is validated.
Saumo reserves the right to refuse an order for legitimate reasons, such as:

Ongoing dispute with the Customer

Refused or suspicious payment

Abnormal or inconsistent order
An order confirmation is sent by e-mail after validation. The Customer is invited to check the order details and contact customer service in case of error.
6. Payment
Payment is due immediately at the time of order.
Accepted payment methods are:

Credit card (Visa, Mastercard, American Express)

Apple Pay

Other methods indicated during payment
Payments are secured through our certified provider (Shopify Payments, Stripe or other). No banking data is retained by Saumo.
7. Delivery
Covered areas
Saumo delivers in metropolitan France, in European Union countries, and in certain non-EU countries.
Lead times
Orders are processed within 1 to 3 working days. To this are added the shipping times:

Metropolitan France: 2 to 4 working days

Europe: 3 to 7 working days

International: 5 to 12 working days
Deadlines are indicative and may vary depending on the carrier and the period.
Delivery fees
Delivery costs are calculated at the time of order. The Customer can choose from several options (standard, express, etc.).
Responsibility
Saumo is not responsible for delivery delays caused by carriers or by exceptional circumstances (strikes, customs, weather, etc.).
In case of a package not collected on time or an incorrect address, reshipment costs will be borne by the Customer.
8. Right of withdrawal and returns
Legal period
In accordance with article L221-18 of the Consumer Code, the Customer has a right of withdrawal of 14 days from the receipt of the product.
Conditions
Products must be returned:

New, unworn, unwashed

With labels and hygiene protection intact
-
In their original packaging
Products not meeting these conditions cannot be refunded.
Procedure
The Customer must make a request to saumoswimwear@gmail.com, then return the product(s) to the address provided. Return costs are borne by the Customer.
It is recommended to use a tracked service.
Refund
Saumo will process the refund within 7 to 10 working days after receipt and validation of the returned items.
Initial delivery costs are not refunded.
9. No direct exchange
For logistical reasons, Saumo does not offer direct exchange.
To change size, model or color, you must make a return and then place a new order on the Site. Make your return request by email to saumoswimwear@gmail.com by providing your contact details and your order number. Delivery costs will be free regardless of the amount of your exchange :).
10. Defective products or order error
In case of receiving a defective product or an error in the order, the Customer must contact customer service within 48 hours with a supporting photo.
Saumo will cover the return costs and offer a replacement or a full refund.
11. Returns outside the EU
For any return made from a country outside the European Union, the Customer must indicate on the package the mention "Return product no commercial value".
Any customs fees levied upon arrival will be deducted from the refund amount.
12. Privacy
Personal data is used only for order management and commercial relations.
Saumo undertakes to comply with current regulations (GDPR).

13. Intellectual property
All elements present on the site (texts, photos, products, logo, brand name) are protected by current intellectual property laws.
Any unauthorized reproduction or use, in whole or in part, is strictly prohibited.
14. Applicable law – Disputes
These General Terms and Conditions are governed by French law.
In case of dispute, an amicable solution will be sought as a priority.
Failing that, the French courts will have sole jurisdiction, unless otherwise mandatory provisions.
